… the decision that the claim is manifestly unfounded if it is of the opinion that the claim is clearly fraudulent. 12. The Act is amended by adding the following after section 109: Designated Countries of OriginMarginal note:Designation of countries of origin 109.1 (1) The Minister may, by order, for the purposes of section 111.1, designate a country or part of a country or a class of nationals of a country. Marginal note:Limitation (1.1) The Minister may make a designation only if (a) the number of claims for refugee protection made in Canada by nationals of the country in question is equal to … or greater than the number set out in the regulations; and (b) the rate of acceptance by the Refugee Protection Division of claims made by nationals of the country in question is equal to or lower than the rate set out in the regulations.
